Basic Criteria for Divorce

Before you start your divorce, make sure you meet the basic criteria for divorce.

Married For One Year

If you have not been married for one year, the law stops you from filing for divorce. This means couples can not file for divorce within the first year of their marriage. Don’t worry, this does not mean that you are helpless until the year passes, there are other options available to help you to get your life back on track. Irretrievably Broken Down and the Five Facts 

When you file for divorce, you have to show the judge that your marriage has irretrievably broken down. This simply means the judge needs see that your marriage has permanently broken down.  You do this by showing the judge that your spouse either committed adultery, behaved unreasonably, deserted you, or that both of you have been separated for either 2 or 5 years.
